1. WHO WE ARE

The St. Louis Art Museum (“SLAM,” “we,” “our,” or “us”) is a nonprofit organization that collects, presents, interprets and conserves works of art and operates a world class art museum in St. Louis where it provides access to exhibits, hosts events, provides educational programs, offers two museum shops and operates a full-service restaurant  (“Services”).  SLAM also owns and operates a publicly accessible website at www.slam.org (“Site”).

As we provide our Site and Services, we collect, process and share information and data.  Some of the data we collect is considered “personally identifiable information,” “personal information” or “personal data” under applicable law (collectively referred to in this Privacy Policy as “Personal Data”). Generally, Personal Data is information that can be reasonably connected to an identified or identifiable individual.  It does not include deidentified or anonymized data.

The purpose of this Privacy Policy is to disclose to you how we collect, use and share information, and how we attempt to safeguard the data you provide to us.  We are committed to securing data that we collect concerning you (“you”) and complying with applicable data protection and privacy laws.

3. WHY AND HOW WE COLLECT DATA

We collect, process, and use Personal Data to provide our Services, to allow you to utilize the functionality, information and features we provide on our Site, to communicate with you, to promote our events and Services, and to solicit membership sales and donations.  The legal basis for our collection of Personal Data is with your consent, for our legitimate business purposes and/or to comply with our legal and contractual obligations.  We obtain Personal Data directly from you, through cookies and other technologies, and from third parties as described in this Policy and any other privacy notices we may provide to you when you interact with us.

  1. Information and content you provide.  We collect the content, communications and other information you provide when you use our Site and Services, including when you message or otherwise communicate with us.
  2. Usage.  We collect data on how you use our Site, such as the content you view or engage with, the features you use, the time, frequency and duration of activities.
  3. Information from our service providers and partners. We collect information from our service providers. For example, we collect information from our payment and donation processors, Blackbaud Merchant Services Resources, MetroTix and TAM Intelliware. Pre-employment information via the Careers and Opportunities section of the web site through our partner, Ceridian and is governed under their own privacy policy. We also obtain information from and share information with other affiliated entities in the Metropolitan Zoological Park and Museum District and other arts organizations for marketing purposes.
  4. Device information.  We collect information from and about the devices that you use to access our Site.

 

4. PROTECTING YOUR PRIVACY GENERALLY
  1. Industry-Standard Protection. We utilize industry-standard security measures to safeguard the information we collect, maintain and use. These measures include technical and procedural steps to protect your data from misuse, unauthorized access or disclosure, loss, alteration or destruction. However, we do not and cannot guarantee the performance or adequacy of such security measures.
  2. Limitation on Access.  Access to any Personal Data we collect, and store is generally restricted to our employees and/or service providers who require it to perform a job or other contracted function. We require vendors and service providers we work with to use reasonable, industry standard protocols to maintain the confidentiality, security, and integrity of Personal Data.

 

5. CHILDREN’S PRIVACY

In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C., §§ 6501-06 and 16 C.F.R., §§ 312.1-312.12, we do not knowingly collect Personal Data from children under thirteen years of age or permit children under 13 years of age to submit their Personal Data to use through our Site.

 

6. TYPES OF INFORMATION WE COLLECT
  1. Information we collect from you.  We collect the information you choose to provide when using our Services or by contacting us through our Site.
  2. Information we collect from service providers and affiliates.  We collect information from our service providers.  For example, we’ll collect information from our payment and donation processors to confirm payment has been made and we’ll collect information from our fundraising service provider when a donation has been received.  We also obtain information from and share information with other affiliated entities in the Metropolitan Zoological Park and Museum District and other arts organizations for marketing purposes.
  3. Information we collect via tracking technology.  We use cookies and other tracking technologies (such as pixels and web beacons) (collectively, “Cookies”) to collect information as you navigate our Site. Cookies are small files of information that are stored by your web browser software on your computer hard drive, mobile or other devices (e.g., smartphones or tablets).We use Cookies to: (a) estimate audience size and usage patterns; (b) understand and save your preferences for future visits, allowing us to customize the online experience to your individual needs; (c) advertise new content, events and services that relate to your interests; (d) keep track of advertisements and search engine results; (e) compile aggregate data about website traffic and website interactions to resolve issues and offer better online experiences and tools in the future; and (f) recognize when you return to our website.The Cookies we use collect the following types of Personal Data:
    Usage Information. We collect information such as which areas of the Site you access, the frequency of access, and what you click on while using the Site.
    Technical Information.  We collect technical information about your connection to our Site, including the Internet protocol (IP) address, browser type and version, browser plug-in types and versions.
    Device Information. We collect information about the device you are using, such as hardware model, operating system, application version number.
    Mobile Device Information. In addition to the device information listed above, when you access our Site on your mobile device, we collect and aggregate information about whether you are accessing the Site via a mobile device or tablet, device type, and carrier.
    Location Information. We collect location information from site visitors on a city-regional basis.

    We set some Cookies ourselves and others are set by service providers. We use Cookies set by service providers to provide us with useful information to help us improve our Site, to conduct advertising, and to analyze the effectiveness of advertising.
  4. How To Opt-Out of Cookies & Learn More.  Cookies can be blocked by changing your settings to refuse all or some Cookies. We use the Personal Data we collect to:

  • Provide you with information about our organization, the arts, our Services and/or our Site;
  • Provide our Services to you;
  • Provide support to you;
  • Maintain, improve and customize our Site and Services;
  • Defend our legal rights and the rights of others;
  • Efficiently maintain our business; and
  • Comply with applicable law.

 

8. INFORMATION WE SHARE WITH THIRD PARTIES

We do not sell personal data.  We may share the information that we collect about you in the following limited ways:

  1. With Service Providers.  We may share information with service providers who:
    • perform data services on our behalf, such as email, hosting, maintenance, backup, analysis, security, etc.);
    • provide other services on our behalf, such as payment processing and nonprofit fundraising services;
  2. To Meet Our Legal Requirements or Exercise Our Rights.  We may share information with third parties in the following instances:
    • When we are permitted or required to do so by law or applicable contracts.
    • In connection with any legal proceedings or prospective legal proceedings.
    • To establish, exercise, or defend our legal rights, including providing information to others for the purposes of fraud prevention.
    • When we reasonably believe it is appropriate to apply to a court or other competent authority for disclosure of that Personal Data where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that Personal data.
    • We may share information with other persons or entities as part of our own business transactions, such as during financing or any asset sale.

 

9. HOW TO ACCESS & CONTROL YOUR PERSONAL DATA

We respect your privacy and provide ways for you to choose whether to share your information with us or any third parties.

You may decline to provide information.  You have the right to decide not to share information with us.

You may request deletion.  You may submit a request to delete your personal data.

PLEASE NOTE, HOWEVER, THAT IF YOU CHOOSE NOT TO PROVIDE US WITH CERTAIN INFORMATION OR ASK US TO DELETE YOUR INFORMATION, WE MAY NOT BE ABLE TO PROVIDE YOU WITH SOME OF OUR SERVICES.  IN ADDITION, IN SOME CIRCUMSTANCES, WE MAY NOT BE ABLE TO MODIFY OR DELETE DATA DUE TO OUR OWN OBLIGATIONS.

You may review and request changes to your personal data.  You may use your account to access, correct, or view certain personal data we have collected which is associated with you or your account.

10. SECURITY

We take industry standard security measures to protect your Personal Data. Unfortunately, the transmission of information via the internet is not completely secure.  Although we will do our best to protect your Personal Data, we cannot and do not guarantee the security of your data.

 

11. LINKS TO THIRD-PARTY SITES

Our Site may contain links to other website and companies that may be of interest to you.  If you click on any of those links, you will leave our Site.  We are not responsible for third-party website.  Therefore, please consult the terms of service and privacy policies of those Site when you visit them.

 

12. DO NOT TRACK SIGNALS

Some internet browsers incorporate a “Do Not Track” feature that signals to website you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, the Site will attempt to interpret, respond to or alter its practices when it receives “Do Not Track” signals.

 

13. DATA RETENTION

We will store your Personal Data for as long as: (a) you maintain a membership or contractual relationship with us; (b) you continue using our Site and/or Services; (c) our data retention plans require; (d) your Personal Data is stored in our back up servers and/or services; or (e) as long as we are legally required to retain the Personal Data.

 

14. ACCESSIBILITY

We are committed to ensuring this Privacy Policy and our Site are accessible to individuals with disabilities.  If you wish to access this Privacy Policy in an alternate format or would like to report an issue you are experiencing on our Site or Services, please email us at privacy@slam.org.  You expressly agree to attempt to resolve any and all issues with accessibility directly with us and in good faith prior to instituting any legal action against us.

 

15. NOTICE TO NEVADA RESIDENTS

Nevada law allows Nevada residents to opt-out of the sale of certain types of personal information. Subject to a number of exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to a person for the person to license or sell the information to additional persons. We do not currently sell personal information as defined in the Nevada law. However, if you are a Nevada resident, you still may submit a verified request to opt-out of sales and we will record your instructions and incorporate them in the future if our policy changes. Opt-out requests may be sent to privacy@slam.org.

 

16. NOTICE TO CALIFORNIA & VIRGINIA RESIDENTS

The California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (“CPRA”) provide certain rights to California residents regarding the collection, use, disclosure and sale of personal information.  Likewise, the Virginia Consumer Protection Act (“VCDPA”) provides certain rights to Virginia residents regarding the collection, use, disclosure and sale of personal information.  As of the date of last revision of this Privacy Policy, we were not / are not subject to the requirements of the CCPA,  CPRA or VCDPA.  If this changes, we will update our Privacy Policy.  In the interim, of you would like to contact us to access and control your Personal Data, please see the options and tools we provide in Section 9 above.  Please also feel free to contact us with any questions.

Shine the Light Law:  If you are a California resident, California Civil Code § 1798.83 permits you to request information regarding the disclosure of your personal information by us to third parties for the third parties’ direct marketing purposes (as those terms are defined in that statute).  SLAM does not sell or disclose information to third parties for their direct marketing purposes.

 

17. NOTICE TO RESIDENTS OF THE EUROPEAN ECONOMIC AREA

The General Data Protection Regulation (“GDPR”) applies to individuals located in the European Economic Area (“EEA”).  The GDPR allows us to collect and use personal information from individuals within the EEA only for one or more of the following reasons:

  1. To fulfill a contract we have with you;
  2. When we have a legal duty;
  3. When it is in our legitimate interest; or
  4. When you provide consent.

If you are located in the EEA, you have a number of rights under data protection laws in relation to the way we process your Personal Data, which are set forth below.  You may contact us directly to exercise any of these rights, and we will verify your request and, if appropriate, respond to any request received from you within one month from the date of the request. In exceptional circumstances we may need to extend this timescale, but we will always tell you in advance if we do, and our reasons why.

Right 1: A right to access personal data held by us about you, as well as information about how we are using your data.

Right 2: A right to require us to rectify any inaccurate personal data held by us about you.

Right 3: A right to require us to erase personal data held by us about you, and where the personal data has been made public, for other controllers processing the personal data to also erase links to, or copy or replication of, such personal data.  This right will only apply where (for example): we no longer need to use the personal data to achieve the purpose we collected it for; or where you withdraw your consent if we are using your personal data based on your consent; or where you object to the way we process your data (in line with Right 6 below).

Right 4: A right to restrict our processing of personal data held by us about you.  This right will only apply where (for example): you dispute the accuracy of the personal data held by us; or where you would have the right to require us to erase the personal data but would prefer that our processing is restricted instead; or where we no longer need to use the personal data to achieve the purpose we collected it for, but you require the data for the purposes of dealing with legal claims.

Right 5: A right to receive personal data, which you have provided to us, in a structured, commonly used and machine-readable format.  You also have the right to require us to transfer this personal data to another organization, at your request.

Right 6: A right to object to our processing of personal data held by us about you (including for the purposes of sending marketing materials to you).

Right 7: A right to withdraw your consent, where we are relying on it to use your personal data (for example, to provide you with marketing information about our services or products).

18. CHANGES TO THIS PRIVACY POLICY

We reserve the right to change, modify or otherwise update this Privacy Policy at any time and in our discretion. When we make material changes to this Privacy Policy, we will provide notice of such changes by posting on the Site, by electronic or conventional mail or by any other means by which you obtain notice of the changes or updates.  Your continued use of the Site and/or Services following our notification of changes means that you accept and agree to the changes.

SLAM uses both first- party and third-party cookies on our website.
